Our Website is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and offer our Service to you.

2.1 Access to our Website is free of charge. You may not use our Website for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

2.2 It is your responsibility to make the arrangements necessary in order to access our Website. Access to our Website is provided on an “as is” and on an “as available” basis. We may suspend or discontinue our Website (or any part of it) at any time. We do not guarantee that our Website will always be available or that access to it will be uninterrupted.

3. General Conditions

3.1 These Terms of Use & Service constitute the entire agreement between us in relation to your purchase. To place an order as a business customer, you must have registered your business in the country where your business is registered with a valid business registration number. If you are a consumer, you must have a registered residence in your country and you must be of legal age in your place of residence. You represent that you have given us your consent to allow any of your minor dependents to use our Website.

3.2 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. You become responsible for a product from the time it is delivered to the address you gave us. You will own a product as goods once we have received your payment in full.

3.3 If we are not accepting your order, we will inform you of this in writing and will not charge you for the products. Inter alia, this might be because (i) the products are out of stock, (ii) of unexpected limits on our resources which we could not reasonably plan for, (iii) we have identified an error in the price or description of the products or (iv) we are unable to meet a delivery deadline you have specified, if any. In any case, we are free not to accept your order without any reason or cause.

4. Our Products

4.1 Our straws are made of wood and plant based binders. They are reusable and certified dishwasher safe (up to 10 times). We actively promote their reusable nature so that people also conceive, perceive and use them as intended.

4.2 Our products are industrially compostable (European standard EN 13432) and biodegrade without leaving permanent micro plastic or toxic residues behind. They have no harmful impact on the ecosystem. They are free from common allergens. They are suitable for any kind of drinks up to 24 hours at 40°C.

4.3 It is recommended to store our products in their closed, original packaging at temperatures below 45°C. Storage in direct sunlight or in a high humidity environment should be avoided. The shelf-life in room temperature (23°C) is 24 months.

4.4 Our products should be used in accordance with their primary purpose. We do not take any form of responsibility with regard to use or incorrect use of our products.

4.5 Some of our products may be available exclusively online or may have limited quantities. They are subject to return or exchange only according to our Return Policy.

4.6 We reserve the right, but are not obligated to:

(a) limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.
(b) limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.
(c) discontinue any product at any time. Any offer for any product or Service made on our Website is void where prohibited.

4.7 The images of our products are for illustrative purposes only. Although we have made every effort to display the colors of the products accurately, we cannot guarantee that your computer monitor's display of any color will be accurate. Your products may therefore vary from those images. We do not guarantee that the quality of any products, services or information purchased or obtained by you will meet your expectations.

4.8 If you wish to change the products you have ordered, please contact us. We will let you know if a change is possible. If it is possible, we will let you know about any changes to the price of the products, the timing of supply or anything else which would be necessary, as a result of your requested change and ask you to confirm whether you wish to go ahead with the change or not. In any case, products should be returned to us in accordance with our Return Policy.

5. Price and Payment

5.1 The price of the products will be the price indicated on the order pages when you placed your order. We will use our best efforts to ensure that the price of the products advised to you is correct. However please see 5.3 for what happens if we discover an error in the price of the product(s) you ordered. The total cost for the purchase will be presented before placing an order.

5.2 If the rate of VAT changes between your order date and the date we supply the products, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

5.3 It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the products’ correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

5.4 We accept the payment methods set out in our Website. You must pay for the products before we dispatch them.

5.5 If you are a business customer you must pay all amounts due to us in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).

5.6 If you think an invoice is wrong, please contact us promptly to let us know.

6. Accuracy Of Billing Information

6.1 You agree to provide current, complete and accurate personal and account information for all purchases made on our Website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete any order you may place with us and contact you as needed.

6.2 We will not be responsible for supplying the products late, if a delivery date is agreed, or not supplying any part of them, if this is caused by you not giving us the correct information.

6.3 We reserve the right to refuse any order you place on our Website. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel your order, we will try to notify you by contacting the e‑mail and/or billing address/phone number that you provided us.

6.4 If you do not pay us for the products when you are supposed to and you still do not make payment within 10 days of us reminding you that payment is due, we may suspend supply of the Products until you have paid us the outstanding amounts.

7. Return Policy

7.1 All orders must be inspected upon delivery. Contact us within 48 hours if the product is defective, damaged, or if you receive the wrong product, so that we may evaluate the issue and make it right. Please, email support@theoceanstraw.com, attaching pictures and outlining any concerns.

7.2 If you are a consumer, you may return a product within 14 days of receipt, being understood that in this case, you shall pay for the return costs. If 14 days have passed, unfortunately we can not accept a return. To be eligible for a return, the product must be in the same condition that you received it, unused, with tags, and in its original packaging. You'll also need the receipt or proof of purchase.

7.3 To start a return, you can contact us via the contact form on our Website or send us an email to support@theoceanstraw.com. If your return is accepted, we’ll send you instructions on how and where to send your package.

7.4 Unfortunately, we cannot accept returns on sale items, gift cards, custom products such as special orders or personalized items.

7.5 We will notify you once we’ve received and inspected your return to let you know if a refund is approved or not. If approved, you’ll be automatically refunded on your original payment method within 14 days. Please, remember it can take some time for your bank or credit card company to process and post the refund too. If more than 14 days have passed since we’ve approved your return, please contact us at support@theoceanstraw.com.

8. Changes To Content, Prices or Service

8.1 We may alter and update our Website (or any part of it) at any time and without notice for technical or commercial reasons, including for the purposes of changing its content, layout, design, functionalities or implementing improvements.

8.2 Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue our Service (or any part or content thereof) without notice at any time.

8.3 We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
